10th July as Public Holiday

10th July 2024 (Wednesday), the date of the bye-elections for the following Assembly Constituencies, has been declared as a public holiday under section 25 of the Negotiable Instruments Act, 1881:

  • 35-Raiganj
  • 90-Ranaghat Dakshin (SC)
  • 94-Bagda (SC)
  • 167-Maniktala
  • Government offices, organizations, undertakings, corporations, boards, statutory and local bodies, and educational institutions within these constituencies will remain shut.

Paid Holiday for Workers

  • The Labour Department will issue instructions to declare 10th July 2024 as a paid holiday.
  • Workers in shops, commercial and industrial establishments, including Tea Gardens, within the concerned Assembly Constituencies to enable them to vote.

Workers Outside the Constituency

Electors registered in the aforementioned constituencies but working outside will also be entitled to a paid holiday under section 135B(1) of the Representation of the People Act, 1951, to enable them to vote.

Re-Poll Provision

In the event of a re-poll, employees and workers will be allowed to vote on the re-poll date in the same manner as specified for 10th July 2024.

Special Leave for Polling Personnel

If polling personnel are released late from Reception Centres(RC) on the poll date, making it difficult for them to attend office on 11th July 2024 (Thursday), special leave may be granted to deserving employees.

Local Holiday for Polling Stations

For Government Offices/Educational Institutions used as Polling Stations, Sector Offices, or Distribution-cum-Reception Centres, the competent authority may declare a local holiday on 9th July 2024 (Tuesday), the date of dispatch.

MEMORANDUM

In view of bye-elections to 35-Raiganj, 90-Ranaghat Dakshin(SC), 94-Bagda(SC) and 167- Maniktala Assembly Constituencies scheduled to be held on 10™ July, 2024 (Wednesday) vide Press Note No. ECI/PN/120/2024 dated 10°” June, 2024 of the Election Commission of India, the undersigned is directed to say that the Governor is hereby pleased to declare the said date of Poll as public holiday under section 25 of the Negotiable Instruments Act, 1881 for the Government offices, Organizations, Undertakings, Corporations, Boards, Statutory and Local Bodies, Educational Institutions situated within the extent of the aforementioned Assembly Constituencies.

2. Labour Department will issue suitable instructions to shops, commercial and industrial establishments including Tea Gardens to declare the said date for the concerned Assembly Constituency as paid holiday for the workers to enable them to exercise their franchise in the election.

3. There may be cases where a person is ordinarily resident in any of the above-mentioned Constituencies and registered as an elector but serving or employed in an industrial undertaking or an establishment located outside the Constituency. In such a situation, such electors including casual workers working outside the constituency concerned will be entitled to the benefit of a paid holiday extended under section 135B(1) of the Representation of the People Act, 1951.

4. In case of re-poll, the employees/ workers shall be allowed to cast their votes on the date of re-poll also in the manner as in Para-2 and Para-3 above.

5. If the poll process continues up to late hours on the poll date, resulting in the late release of Polling Personnel from Reception Centres rendering it difficult for them to attend office in time on 11″ July, 2024 (Thursday), special leave may be allowed for that day to deserving employees only.

For the Government Offices/Educational Institutions etc. which will be used as Polling Stations/Sector Office/ Distribution-cum-Reception Centre, local holiday may be declared for the said institutions/establishments by the Competent Authority on the date of dispatch i.e. 9″ july (Tuesday).
